Vet Claim Solutions Referral Program

Subject to the Vet Claim Solutions’ Referral Program Terms and Conditions below, when you refer a new client to Vet Claim Solutions and such client, upon the assistance of VA Claims Team Strong, wins his/her claim with the Department of Veterans Affairs, you will receive a Reward.

Terms and Conditions

The Vet Claim Solutions (the "Program") is a long-term referral partnership that enables Members to earn Rewards by recommending our Services to Qualified Referrals. To participate, you must agree to these Referral Program Terms and Conditions (the "T&C") and our Privacy Policy.

1. Definitions

1.1. "Services" mean Vet Claim Solutions’ assistance in filing a client’s claim with the Department of Veterans Affairs or any related services.

1.2. "Member" means someone who meets all the following conditions:

1.2.1. any user of the Services, whether a client or non-client of Vet Claim Solutions, who registers in the Program and promotes the Services using his/her Referral Identification Number/Code; and

1.2.2. any user of the Services who is, legally, a resident of the United States of America; and 

1.2.3. any user of the Services that is over 18 years of age.

1.3. "Referral Identification Number/Code” means the unique referral identification number/code assigned to a Member by Vet Claim Solutions.

1.4. "Pending Referral" means someone who meets all the following conditions:

1.4.1. any former service-member of the Uniform Services who is looking for assistance with filing a VA disability claim and has completed their Information Form on our Program Landing Page.

1.5. "Qualified Referral" means a Pending Referral that submitted his/her claim with the Department of Veteran Affairs, having an active contract of services with Vet Claim Solutions

1.6. “Approved Referral” means an Qualified Referral that wins his or her disability claim that was submitted to the Department of Veteran Affairs.

1.7. "Reward" means an amount paid to the Member resulting from the Pending Referral becoming Qualified and or Approved.

2. Overview of the Program

2.1. Vet Claim Solutions will provide you with a Referral Identification Number/Code which you must add to every link you use to promote the Services in order for Vet Claim Solutions to associate you with your referral.

2.2. You can earn a Reward only if you refer a Pending Referral to Vet Claim Solutions and that Pending Referral becomes an Qualified Referral and further onto an Approved Referral. You may be neither an agent of the Pending Referral nor the Qualified Referral.

2.3. For each Qualified Referral, the Member who referred the Qualified/Approved Referral will be awarded a Reward in the form and amount described below at Provision Number 4.

2.4. By taking part in the Program, you agree to:

                  2.4.1.  comply with all applicable commercial and public anti-bribery laws; and

                  2.4.2.  send referral emails only to people that you know; and

2.4.3.  not engage in any activity that may be considered fraudulent, invasive, or spamming.

3. Multiple Referrals

3.1. A Member may refer as many veterans as he/she may want; however , all Rewards attributable to each Qualified Referral shall be subject under this same T&C.

4. The Reward

4.1.  An amount equivalent to $50.00 shall be given to the Member once his/her Pending Referral submits a claim with the Department of Veteran Affairs thus, becoming an Qualified Referral; and

4.2. In the event that the Qualified Referral wins his/her disability claim with the Department of Veteran Affairs using the assistance of Vet Claim Solutions and that the Qualified Referral has paid its initial amount due to Vet Claim Solutions, a commission of 5% of the total service fees charged by VCS to the Qualified Referral will be paid to the Member, representing a completed referral fee. IF VCS IS UNABLE TO OBTAIN a payment from the Qualified Referral then no payment will be made to the Member until so. If the Qualified Referral is delinquent on his/her service fees for 1 year then the commission associated with the Qualified Referral  by the Member will be considered LOST.

4.3. If in case the Qualified Referral’s disability claim with the Department of Veteran Affairs is denied, the Member neither will receive nor is qualified to receive any amount, other than the $50.00 initially given.

5. Taxes and Fees

5.1. The Member is responsible for all applicable taxes and fees resulting from the earnings gained with the Program. Per the IRS, any income excess of $600 or more within a calendar must be reported by the Member.  To receive Rewards over $600 the Member will be required to provide a completed IRS Form W-9, Request for Taxpayer Identification Number and Certification before rewards can be released that are in the excess of over $600.. 

5.2. In the event that a member exceeds $600 of rewards within a calendar year, the Program will issue Member a 1099-MISC with the cumulative amount earned for that year. It is the sole responsibility of the Member to report this income to the IRS on his or her annual filing and shall have no liability or whatever impact on Vet Claim Solutions.

6. Release of Liability

6.1. By participating in the Program, you release Vet Claim Solutions and its members, parent company, subsidiaries, affiliates and their respective directors, officers, employees, and agents from any and all liability for any loss, harm, damages, cost, or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Program and/or the use of any Program rewards.

7. Severability

7.1. If any provision in these T&C are held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void, or unenforceable) will be struck and will not affect the validity of and enforceability of the remaining provisions.

8. Termination and Change

8.1. Vet Claim Solutions may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program or this T&C at any time, without notice. Vet Claim Solutions may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Program for breach of these T&C or taking any actions that are inconsistent with the intent of these Program’s T&C.

8.2. Vet Claim Solutions reserves the right to suspend accounts or deny any Rewards if we notice any activity that we believe is abusive or fraudulent. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals as we deem fair and appropriate.

9. Updates to these T&C

9.1. Vet Claim Solutions can update these T&C at any time without prior notice. If Vet Claim Solutions modifies these T&C, an email notifying of the changes that took place will be sent out to Members and such modification is effective upon posting. Continued participation in the Program after any modification shall constitute consent to such modification.

10. Binding Effects

10.1. By participating in the Program, you agree to and are bound by the Program T&C. If you do not wish to agree to and abide by the Program T&C in their entirety, you are not authorized to participate in the Program.

11. Code of Conduct

11.1. Members cannot refer themselves or create multiple, fictitious, or fake accounts with the Program. No Member may use the Program to violate any law, infringe or violate the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, obscene or outside the spirit and intent of the Program. In addition, you may not:

                11.1.1. Tamper with the Program; and

                11.1.2. Act in an unfair or disruptive manner; and

11.1.3. Use any system, bot or other device or artifice to participate or receive any benefit in the Program. This includes  but is not limited to a general prohibition on posting of the referral codes on any website which offers the referral code to anyone other than Friends (i.e. individuals to whom you personally know). If we believe that a referral code associated with a Member’s account was used in such a manner, we have the right to remove all credit associated with that account and remove the Member from the Program; and

                11.1.4. Spam or otherwise create bulk distributions of the Referral link that is inappropriate; and

11.1.5. Collect or attempt to collect personal data about the Pending, Qualified and Approved Referrals or potential Pending, Qualified and Approved Referrals; and

                11.1.6. Engage in actions that are designed to disrupt or undermine the Program; and

                11.1.7. Attempt to gain unauthorized access to the Program or its system, for any reason; and

                11.1.8. Engage in behavior designed to annoy or harass others; and

                11.1.9. Engage in actions that disparage or malign or call into question the reputation of Vet Claim Solutions

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

12. Indemnification

11.1. You, as the Member, agree to indemnify, defend, and hold Vet Claim Solutions and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs, or expenses, including attorney’s fees and costs, arising from, or related to any breach by any of your Pending, Qualified, and/or Approved Referral of any of these Program T&C or any violation by your Pending, Qualified and/or Approved Referral of applicable law.

13. Applicable Law

13.1. This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation, including non-contractual disputes or claims, shall be governed by and construed in accordance with the law of the state of Virginia.

14. Other Terms

14.1. General Terms. These Program T&C constitute the entire agreement between the Members and Vet Claim Solutions concerning the Member’s joining of the Program. The failure of Vet Claim Solutions to exercise or enforce any right or provision of these Program T&C shall not constitute a waiver of such right or provision. If any provision of these Program T&C is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Program T&C remain in full force and effect. The section titles in these Program T&C are for convenience only and have no legal or contractual effect.  A person who is not a party to these Program T&C shall have no right to enforce or receive the benefit of any of these Program T&C.
